Chetwynd: The Toton and Chilwell Neighbourhood Plan
A referendum was held on Thursday, 2 May 2024 on the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The question asked in the referendum was:
“Do you want Broxtowe Borough Council to use the Neighbourhood Plan for Chetwynd: Toton and Chilwell to help it decide planning applications in the neighbourhood area?”
The number of votes cast in favour of ‘yes’ was 3,606 and those in favour of ‘no’ was 552. The turnout was 36%.
Paragraph 38A (4) of the Planning and Compulsory Purchase Act 2004 (as amended) requires that the Local Planning Authority must ‘make’ a Neighbourhood Plan if more than half of those voting have voted in favour of the Plan.
The Borough Council is not subject to this duty if the Borough Council considers that the making of the plan would breach, or would otherwise be incompatible with, any EU obligation or any of the Convention rights (within the meaning of the Human Rights Act 1998).
The Borough Council does not consider that the Plan would breach, nor be otherwise incompatible with any EU obligation or any of the Convention rights (within the meaning of the Human Rights Act 1998).
Accordingly, Broxtowe Borough Council resolved to ‘make’ (adopt) the Chetwynd: The Toton and Chilwell Neighbourhood Plan at its meeting of the Full Council on 15 May 2024. In accordance with the Regulations and the Borough Council’s procedure, the Chetwynd: The Toton and Chilwell Neighbourhood Plan is ‘made’ and planning applications in the area must be considered against the Chetwynd: The Toton and Chilwell Neighbourhood Plan, as well as existing planning policy.

The Borough Council will forward a copy of this Decision Statement to all individuals and organisations that asked to be notified of the decision.

Decision Statement
Cabinet resolved at its meeting on Tuesday, 6th February 2024, that:
- The Chetwynd: The Toton and Chilwell Neighbourhood Plan should be modified as proposed by the Independent Examiner.
- Once modified as proposed by the Independent Examiner, it is considered the Neighbourhood Plan will meet the Basic Conditions and other legislative requirements.
- The Chetwynd: The Toton and Chilwell Neighbourhood Plan should proceed to a referendum, with the extent of the area eligible to vote to be based upon the Chetwynd: The Toton and Chilwell Neighbourhood Area as shown within appendix 1 to the report.

Public Consultation: Proposed Amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan/Consultation Responses
In response to the Independent Examiner’s Procedural Letter of 13th July 2023 (Opens in a New Window), Broxtowe Borough Council invited comments on the proposed amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan and the Policies Map during a 4 week period which ended on Friday 25th August 2023. This consultation period has now ended.
The proposed amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan are set out within a ‘Consultation Document(.pdf)(16.8MB)(Opens in New Window)’ (Opens in a New Window). Some of the proposed amendments are shown by ‘track changes’, although some sections (including the proposed amended policies) are not shown in this format, to allow greater clarity. Broxtowe Borough Council Update 14th March 2023
On Wednesday 8th March, Broxtowe Borough Council submitted a draft ‘schedule of amendments’, setting out the proposed modifications, as discussed with the Chetwynd: The Toton and Chilwell Neighbourhood Forum, to the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The Borough Council is currently awaiting the response of the Independent Examiner to this schedule and supporting documents. Further information will be added to this website page when it is available.
Broxtowe Borough Council Update – 28th February 2023
Broxtowe Borough Council is continuing to work with the Chetwynd: The Toton and Chilwell Neighbourhood Forum to produce a ‘schedule of amendments’ setting out the proposed modifications to the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The Independent Examiner has granted extensions to the deadline to allow this work to be finalised. It is expected that the Borough Council and Neighbourhood Forum will be in a position to send the schedule of amendments to the Independent Examiner within the next week or so. Subject to the comments and recommendations of the Independent Examiner at this point, the Borough Council envisages that the schedule of amendments will then be the subject of a further limited period of public consultation.

In accordance with Section 61F of the Town and Country Planning Act 1990 (as amended), Broxtowe Borough Council resolved at its meeting on 2nd March 2022 to re-designate the Chetwynd: The Toton and Chilwell Neighbourhood Forum for the Chetwynd: The Toton and Chilwell Neighbourhood Area(.pdf)(5.08MB)(Opens in New Window) (Opens in a New Window).
Regulation 10 of the Neighbourhood Planning (General) Regulations 2012 (as amended), requires that the following information in relation to the re-designation of the Chetwynd: The Toton and Chilwell Neighbourhood Forum be published by the local planning authority:
- The name of the Neighbourhood Forum: Chetwynd: The Toton and Chilwell Neighbourhood Forum;
- A copy of the written constitution of the Neighbourhood Forum(.pdf)(358KB)(Opens in New Window) (Opens in a New Window).
- The name of the Neighbourhood Area to which the designation relates: Chetwynd: The Toton and Chilwell Neighbourhood Area; and,

Background
The Chetwynd: The Toton and Chilwell Neighbourhood Forum submitted an application to ‘re-designate’ the Neighbourhood Forum, as the original designation was due to expire on 9 March 2022.
The Forum’s application(.pdf)(244KB)(Opens in New Window) (Opens in a New Window) included the following information:
(a) the name of the proposed Neighbourhood Forum;
(b) a link to a copy of the written constitution of the proposed Neighbourhood Forum;
(c) the name of the neighbourhood area to which the application relates and a link to a map which identifies the area;
(d) the contact details of at least one member of the proposed Neighbourhood Forum to be made public under regulations 9 and 10; and
(e) a statement which explains how the proposed Neighbourhood Forum meets the conditions contained in section 61F(5) of the 1990 Act.
Please note that as the Council has taken the decision to re-designate the Neighbourhood Forum, no other organisation or body may be designated for this neighbourhood area until this designation expires or is withdrawn.
